More than 2.3 million units of counterfeit products were revealed by South Russian customs officers for the first half of 2018

In the Southern Customs Office, monitoring the enforcement of intellectual property rights when moving goods across the customs border has traditionally been one of the most important activities. Particular attention was paid to this work in connection with the World Cup 2018.

For 6 months of 2018, 2.39 million units of counterfeit goods were identified and recognized as counterfeit, of which more than 74 thousand items of counterfeit goods with FIFA symbols were found. The total number of counterfeit goods identified in the first half of 2018 is almost three times higher than last year's figures (for 6 months of 2017, 836,000 items of counterfeit goods were identified by the UTU). The number of counterfeit goods with FIFA symbols increased by more than 50 times compared to last year (in the first half of 2017, 1,468 items of counterfeit goods with FIFA symbols were identified). The range of products with the Championship symbols also expanded: last year it was represented by soccer balls, T-shirts, men's baseball caps, mugs and covers for mobile phones, and in 2018 caps, caps, glasses, wigs and other accessories for fans, trinkets, printed advertising products, T-shirts and sports suits, electronic football games.

The total amount of prevented damage from the importation of counterfeit goods for 6 months of 2018 was more than 298 million rubles, which is more than six times higher than in 2017.

The largest consignment of counterfeit goods was revealed on the eve of the championship by Novorossiysk customs officers. The center of operative monitoring of Novorossiysk customs during the monitoring of the commission of customs operations in real time mode revealed two commodity consignments of Chinese goods with signs of counterfeiting.

By order of one of the Moscow region firms to the port of Novorossiysk, containers were delivered by sea vessels, among which customs officers in the course of actual control discovered allegedly counterfeit items: "fan's wig, fan's cap, fan's sleeve tattoos, fan points, fan's cap". On the packaging and labels of fan accessories was marked "FIFA", which is a registered trademark. The total number of goods that caused suspicion among officials of Novorossiysk customs, amounted to 71040 units. The representative of the right holder confirmed that the packaging of the goods being transported is marked with signs similar to the confusion with the trademark registered in the name of "Federación Internacional de Football Socionación", while the goods themselves have signs of counterfeiting, and also reported that no contracts granting the right to use commodity signs, with a company outside Moscow was not concluded. In relation to the recipient of the goods, which infringed on the customs territory of the EAEC, two cases were brought about administrative offenses under Part 1 of Article 14.10 of the Code of Administrative Offenses of Russia (illegal use of means of individualization of goods).

As part of the work to protect intellectual property rights, control is exercised not only when goods arrive in the customs territory, but also in the future - on the domestic market. One of the largest lots of counterfeit goods with FIFA symbols - more than 1,000 items of children's clothing - was revealed by Rostov customs officers in the context of customs control after the release of goods. In the course of the audit it was established that in three outlets leased by the Rostov businessman, the sale of garments with the inscribed symbols devoted to the World Cup 2018 was carried out. The corresponding permission of the owner was absent from the entrepreneur. The identified products were recognized as counterfeit by the representative of the copyright holder of LLC "Intellectual Property Agency". In the case of an entrepreneur, cases were brought about administrative offenses under Part 2 of Article 14.10 of the Code of Administrative Offenses of the Russian Federation (sale of a product containing illegal reproduction of someone else's trademark). Identified counterfeit products in the amount of 1,344 units were withdrawn from civil circulation.
