The Federation Council at the final meeting of the autumn session adopted an appeal to the government with a request to introduce a temporary ban on the wholesale and retail sale of the so-called nikpeks - lollipops and marmalade containing nicotine. These products pose a health hazard but are not subject to any regulation.
“The Federation Council expresses deep concern over the situation in the country related to the spread of sucking and chewing nicotine-containing non-tobacco products (nikpeks) - analogues of sucking tobacco (snus) banned from wholesale and retail trade in the Russian Federation. Nicotine is the main component of the nikpek,” the chamber said. “These products are also available in the form of chewing marmalade, sweets with various and flavoring additives in bright packaging, which makes it especially attractive for children and adolescents.”
Senators provide expert estimates according to which the concentration of nicotine in one batch of nikpek is from 20 to 60 mg of nicotine. For comparison - in one cigarette it is not more than 1 mg. Thus, "candy" contributes to the rapid formation of nicotine addiction, the document says.

"Currently, there is a significant increase in the consumption of nikpeks among children and adolescents," the senators say. Doctors, according to their data, record an increase in circulation in connection with an overdose of nicotine due to the use of similar products.

The problem itself will not be solved, parliamentarians are sure, since the manufacture and sale of nickpacks is a very profitable business. The appeal of the Federation Council states that the cost of producing one package of a dangerous treat is from 15 to 50 rubles, depending on the size of the batch, and the average retail price is about 300 rubles. That is, the profit is from 550 to 2000 percent.

However, the legislation does not regulate the circulation of these products in any way, since it does not contain tobacco and does not fall under the influence of anti-tobacco restrictions.

"Based on the foregoing, the Federation Council calls on the Government of the Russian Federation to take operational measures to prevent mass poisoning by nicotine, including among children and youth, and to suspend the wholesale and retail trade of sucking and chewing nicotine-containing non-tobacco products," the resolution said.
The urgency of introducing such measures is due to the fact that it will not be possible to adopt a legislative ban before the spring session of the State Duma, Valery Ryazansky, head of the Federation Council committee on social policy, explained. The necessary amendments can be made to the bill, which equates the smoking of electronic cigarettes, vapes and hookahs in public places with ordinary cigarettes. He is preparing for a second reading after the New Year holidays.

"Due to the fact that we have school holidays so that they are not overshadowed by such tragedies, our committee suggests accepting an appeal to the government with a request to temporarily suspend, until the adoption of state regulation, the wholesale and retail trade in nikontin-containing substances," he said.

Such products appeared on the Russian market just a few months ago, Valery Kirilishin, deputy head of the State Drug Control Department of the Ministry of Internal Affairs of the Russian Federation, clarified. According to him, recently Rospotrebnadzor equated it with food products, which will allow it to take at least some regulatory measures in a legal vacuum in relation to nikpeks.

"We will turn to Dmitry Anatolyevich (Medvedev), we hope that the government will quickly respond to our appeal and pass a ban on the adoption of the relevant law," said Federation Council Speaker Valentina Matvienko.

"But these criminals are more quickly adapting to our legislation: one is banned - the other immediately appears," she said, referring to the recent ban on snus and nasvay. According to Matvienko, you should not make a difference between tobacco and non-tobacco nicotine-containing products. “It makes no difference where nicotine comes from. We’ll ban it now, they’ll come up with something new, with a different name, but essentially the same thing they poison children with,” said the head of the Federation Council.

Matvienko also suggested publishing a list of nickpeck manufacturers. According to Valery Ryazansky, many of them are Russian enterprises registered in Moscow and the Moscow region.
